1. Agreement to Terms

By accessing or using NOMADO ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all users, including free and paid plan subscribers.

2. Description of Service

NOMADO provides:

• Document expiry date tracking
• Automated WhatsApp/SMS reminders
• Document renewal checklists
• AI-powered document assistance
• Family document management
• Expat service directory

3. Eligibility

• You must be at least 18 years old to create an account
• You may manage documents for your minor children or dependents
• You must provide accurate information
• One account per person

4. User Responsibilities and Messaging Consent

You are responsible for:

• Entering accurate document expiry dates
• Keeping your account credentials secure
• Verifying visa/document requirements with official sources
• All actions taken under your account
• Ensuring WhatsApp/mobile numbers belong to you or consenting recipients

By providing your mobile or WhatsApp number, you consent to receive automated reminder messages from NOMADO via SMS and/or the WhatsApp Business API. Message frequency typically ranges from 1–10 messages per month depending on your settings. Message and data rates may apply. You can opt out at any time by replying STOP, or reply HELP for assistance. We do not sell, rent, or share your mobile number with third parties for marketing purposes.

5. Disclaimer of Liability

NOMADO is a reminder and organizational tool. We expressly disclaim all liability for:

• Missed reminders due to WhatsApp/SMS delivery failures
• Incorrect information provided by the AI Assistant
• Changes in visa/immigration requirements
• Visa rejections, overstays, or immigration penalties
• Any loss resulting from reliance on NOMADO data

Always verify immigration requirements with official government websites or a licensed immigration attorney.

6. Subscription and Payments

• Free plan available with limited features
• Paid plans billed monthly or annually via Stripe
• Prices displayed in USD and may vary by region
• Subscriptions auto-renew unless cancelled
• Cancel anytime from your account settings
• No prorated refunds for mid-cycle cancellations

7. Prohibited Uses

You may not use NOMADO to:

• Share or sell access to your account
• Attempt to reverse-engineer or exploit the service
• Send spam or unsolicited messages via WhatsApp/SMS integration
• Provide a mobile number that does not belong to you or that you are not authorized to use
• Violate any applicable laws or regulations
• Upload false or misleading document information

8. Intellectual Property

All NOMADO content, branding, design, and software are owned by NOMADO LLC. You may not copy, modify, or distribute any part of the Service without written permission. Your document data remains yours — we claim no ownership over it.

9. Termination

We may suspend or terminate accounts that violate these Terms. You may delete your account at any time from Settings. Upon termination, your data will be deleted within 30 days.

10. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States. Any disputes shall be resolved through binding arbitration in Wyoming, except where prohibited by law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOMADO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless NOMADO LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Force Majeure

NOMADO shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: WhatsApp/Meta service outages, Twilio service outages, Supabase or Vercel downtime, internet disruptions, acts of God, or government restrictions.

14. Dispute Resolution & Arbitration

Any dispute arising from these Terms shall be resolved through binding individual arbitration under the American Arbitration Association rules, conducted in Wyoming, USA. You waive any right to participate in class action lawsuits or class-wide arbitration.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Changes to Terms

We may update these Terms with 14 days' notice for material changes. Continued use of NOMADO after changes take effect constitutes acceptance.
